Terms and Conditions
1.0Definitions
1.1 ‘The seller’ is UK Equipment
services.
1.2 ‘The customer’ is the
purchaser of the goods and services.
1.3 ‘Goods and services’
are goods products or services of any kind manufactured or sold by the seller.
2.0 Application of terms
2.1All goods and services
are sold or provided by the seller on the following conditions that shall prevail unless otherwise agreed in writing
by the seller.
2.2 No servant or agent of
UK Equipment Services has the power to vary these conditions verbally
2.3 These general
conditions may be subject to further special conditions as may be prescribed in
writing by UK Equipment Services. In the event of any conflict between the
special conditions and the general conditions, the special conditions shall
prevail.
2.4 No contract shall
exist between the seller and the customer except upon the conditions set out
herein.
3.0 Quotations and Pricing
3.1 All quotations and
tenders are based on the Seller’s list price prevailing at the time
3.2 All quotations are
valid for three months from the date of the quotation.
3.3 If any prices charged
to the Seller by another supplier rise or any other of the Seller’s costs rise
after the date of the quotation or tender has expired, the price paid by the
Customer shall increase by the extra costs to the Seller.
3.4 All quotations are
personal to the Customer to whom they are addressed and are not transferable.
3.5 Under the Chronically
Sick & Disabled Persons Act individual disabled persons may apply for
exemption from the requirement to pay VAT on certain purchases. VAT at the rate
prevailing may be added to the net total of quotations for all vatable supplies
if there is a change in the law. The Seller will require the completion of a
formal declaration of disability in each case.
3.6 VAT will be added to
the accounts of all non-disabled customers where appropriate and to accounts of
disabled people who are unable or unwilling to provide a formal declaration of
disability.
4.0 Cancellation
4.1 Subject to the
Statutory Rights of the Customer the Seller reserves the right to levy a
cancellation charge on all orders cancelled after the order has been placed and
cannot be stopped and which incur a charge to the Seller.
4.2 All cancellations must
be confirmed in writing and authorised by Senior Management.
4.3 If the good and services
have been received and subsequently cancelled the customer agrees to

Store the goods separately from all other goods, as to be
identifiable to the Seller.

Be responsible for any loss or damage to the goods or services,
however caused.
Return cancelled items within a seven working day
period
4.4 The Consumer
Protection Distance Selling Regulations 2000 (order placed via the internet)
allows the customer a seven working day cancellation period
5.0Delivery
5.1 Delivery dates are
stated as accurately as can be currently estimated but are not guaranteed and
do not constitute part of the terms of the contract. The Seller shall not be
liable for any costs incurred for reasons of delay or cancellations in
delivery.
5.2 Any complaint relating
to faulty or damaged goods or short delivery must be notified to the Seller
within 3 days of date of delivery.
5.3 Unless otherwise
agreed by the Seller, delivery shall be made to the delivery point specified in
the order.
5.4 Carriage on all UK
orders is free unless otherwise stated.
6.0 Warranty
6.1 The goods must
correspond with any description, be of satisfactory quality, be fit for the
normal purpose, correspond with the sample, if bought by sample.
6.2 Any defect occurring during any warranty period covered by the manufacturer
must be notified immediately to the seller giving full information as to the
problem. No use must be made of the goods and no alteration or unauthorised
repairs made to the goods prior to inspection by the Seller.
6.3 For goods not
manufactured by the Seller, the Seller gives no assurance of guarantee that the
sale or use of the goods will not infringe patent copyright or other
intellectual property rights of any other person or company. Warranties given
by other suppliers as to the fitness of the goods sold by the Seller will be
applied in the same terms to the Customer.
7.0Payment For Goods & Services & Ownership
7.1 For non-account
customers payment for goods or services must be made at the time of delivery or
immediately on completion
7.2 For account customers
payment must be made within 28 days of the date of the Invoice.
7.3 The Seller reserves
the right to charge interest at 5% above Bank of England Base rate on any
outstanding amount due from the due date to the actual date of payment.
7.4 The Seller &
Customer expressly agree that until the Seller has been paid in full for all
goods and services supplied they will remain the property of the Seller.
7.5 Notwithstanding any
refundable deposits / advance payments by the customer, the Seller does not
automatically operate a buy back policy.
8.0 Force Majeure
8.1 The Seller shall not
be liable to the customer for any delay loss or damage suffered by the customer
as a result of any cause whatsoever outside the Sellers control.
8.2 The company accepts no
responsibility for any loss arising out of or in connection with this
agreement.
